DEERFIELD BEACH, FL (December 13, 2017) — Plaintiff’s personal injury and commercial litigation law firm Rader Law Group announces a jury verdict that exceeded the maximum enforceable recovery against the City of Miami.  The verdict given by the jury was $206,308.65; the maximum collectible under Florida’s sovereign immunity laws was $200,000.  The City had offered $25,000 in settlement.

Andrew Rader, the lead counsel for the plaintiff, described the case as follows:

Our client sustained serious injuries when she was struck on the driver side of her car by a City of Miami police car. Injuries included a tear of the labrum of her shoulder (Type 1 SLAP tear) which required arthroscopic shaving.

The case was tried before a jury in Miami Circuit Court.  During trial the City was forced to admit that it was negligent.  Still, the City disputed the damages that the plaintiff suffered. After robust and vigorous cross examination of the defense case, the jury saw the severity of the injury to the Plaintiff.

“The problem with cases against cities is that Florida law only allows for recoveries up to $200,000, so the cities offer only a small percentage of the proper value of the cases because they know they can’t be held responsible for over $200,000. Well, that’s what happened here, but a thoughtful jury gave our client a recovery in excess of the $200,000 and the City had to pay it,” observed Rader.

The jury awarded the plaintiff $206,308.65 which included $66,308.65 in past medical expenses, $20,000 in past pain and suffering; and $120,000 for future pain and suffering. “The City was being stingy, and we would not stop fighting for our client until she was fully compensated, ” Rader said. “So we took them to trial and a jury gave her what the City wouldn’t. That’s our job. Justice Served.”

Rader was delighted with the outcome. “We got every penny we could under the law. You can’t ask for more than that!”
