So you’ve been injured and you think
you may have a case. Now what?

Call us immediately. We are aggressive, pre-emptive and meticulous attorneys. We want to get to the scene, talk to witnesses and conduct other investigation as soon as possible. We want to see if there are video cameras that captured the event before they are destroyed. Often, the people who own the cameras don’t even know they have the incident captured and the recording gets automatically erased. We need to get out there to see if there’s video that we can use in the case. Sometimes we call in civil engineers, accident reconstruction analysts or other experts to take measurements, photos and conduct thorough investigations, and this needs to be done while the evidence is fresh. Vehicles may need to be inspected before they’re destroyed or, worse yet, before the defense gets in and destroys the best evidence there is. Much may need to be done as quickly as possible.

Besides taking immediate action in investigation, we need to send out spoliation letters to ensure that evidence does not get destroyed. Did you know that if you do not send out spoliation letters, the defense is not required to maintain cars or other evidence? They can destroy, tamper with,, alter or otherwise spoliate what might have been the best evidence you had.

Lastly, once we represent you we can prevent the insurance companies from harassing you and trying to get you to make the common mistake of settling a case for far less than its value. The insurance company will deal with us only, and we will then take on all the responsibility- and costs- of properly prosecuting your case.

Also, your health is the most important thing in your life. We’ve settled cases for millions of dollars, and not one of those clients would not give back the money to have their good health back. Money is important, but health is paramount. Sometimes, you may be injured and not realize it, such as when there are internal injuries that you cannot feel because you don’t have pain receptors in the area of injury. Get yourself checked out immediately. If your injury results from a car collision, then your PIP (Personal Injury Protection) insurance will likely cover it. But, even if you’ll have to pay for an ER visit or deductible, get yourself checked! Not only is this good for your health, but it will prevent the defense from raising the bogus argument that if you were hurt you would have gotten checked.

As we mentioned above, your PIP insurance will cover your doctor visit. However, if you do not seek care within 14 days of the collision you will lose your $10,000 in PIP coverage. You must get care within 14 days to get the coverage. Otherwise, you may be on the hook for the bills.

There is much to be done right after an injury. Give us the ball, and we’ll run with it while you can get on with your healing and your life, confident that your case is being handled aggressively and correctly.
