Nursing Home Abuse and Neglect

When you admit a family member or loved one into a nursing home or long term care facility, you do so with the trust that the facility’s staff will provide them with proper treatment and care on an individual level. However, an alarming number of nursing home residents have been subject to neglect and abuse. While nursing home abuse goes largely unreported, this neglect and abuse can be harmful to your loved one’s health, and in some cases may even be fatal.

Common forms of nursing home abuse:

  • Psychological abuse
  • Sexual abuse
  • Physical abuse
  • Gross neglect
  • Monetary exploitation

Signs of abuse or neglect to look for:

  • Strange bruising
  • Bed sores
  • Soiling or poor hygiene
  • Physical or emotional withdrawal
  • Unresponsive behavior
  • Abnormal financial transactions or disappearance of personal items

Know your loved one’s rights:

In 1987, the state of Florida passed the Nursing Home Reform Act setting forth the basic standards of quality care for nursing home residents. This Act contains a Bill of Rights for residents which includes the following:

  • Freedom from mistreatment, abuse and neglect.
  • To be treated with dignity.
  • To expect privacy.
  • To participate in resident and family groups.
  • Accommodation of physical, medical, psychological and social needs.
  • To communicate freely and privately.
  • Visitation by any person providing social, health legal or other services.
  • Examination of results of recent facility inspections.
  • Freedom of choice regarding physician or pharmacy.
  • Be transferred or discharged only for medical reasons, safety of other patients or nonpayment.
